Ratio Decidendi

The court found that service of summons was not properly effected on all defendants as required by Order 5 Rule 7 of the Civil Procedure Rules. The process server only served four of the fourteen defendants and there was no evidence that those served were agents empowered to accept service for the others or were in charge of the property. The court held that proper service is a fundamental requirement for a fair hearing and that failure to serve all defendants invalidates the ex parte judgment. Consequently, the court set aside the judgment in respect of all defendants, including those who were served, to ensure fairness and allow all defendants an opportunity to defend the suit.
