Ratio Decidendi

The court held that while the defendant advocate, acting as a stakeholder/trustee, is liable to reimburse the plaintiffs the judgment sum, there was no evidence that the plaintiffs had borrowed funds or incurred the contractual interest rate claimed. The court found that the contractual rate in the agreement for sale did not automatically bind the advocate, who was not a party to that agreement. In the absence of proof of actual loss or borrowing, the fair and reasonable rate of interest to be applied is that which the plaintiffs would have earned had they placed the sum on deposit with a commercial bank. The court therefore awarded interest at 14% per annum from the date of the agreement...
