The Court of Appeal held that the prior decision by Simpson J in Civil Case No 2380 of 1980, awarding double rent for the 16 days in June 1980, was fundamentally based on the finding that the tenant was holding over from the expiry of the only notice given, which expired on 31st March 1980. The period for which double rent was awarded was part of a continuous holding over commencing from 1st April 1980. Although the landlord did not claim double rent for April and May in that suit, having already recovered it by distress, the court found that the issue of the tenant's liability for double rent for that period was necessarily and conclusively determined.
