Ratio Decidendi

The court found that under Section 26 of the Mental Health Act, only the High Court has jurisdiction to appoint a guardian ad litem or manager for the estate of a person suffering from mental disorder. The appointment of R N O by the subordinate court was therefore null and void, as the subordinate court lacked jurisdiction. Consequently, R N O had no legal capacity to institute the suit on behalf of D O M. The suit was thus incompetent and had to be struck out. The court also vacated all interim orders made in the suit, and ordered that costs be paid by R N O.
