Ratio Decidendi

The court found that the Petitioner had established, on a balance of probabilities, that the marriage had irretrievably broken down due to the Respondent's cruelty and desertion. The Respondent's failure to respond to the petition or appear in court left the Petitioner's evidence unchallenged. The court was satisfied that there was no will to salvage the marriage, particularly on the part of the Respondent, and that the legal grounds for dissolution had been met under the Marriage Act. Accordingly, the court ordered the dissolution of the marriage and issued a decree nisi to be made absolute after thirty days.
