Procedural Posture

Miscellaneous Application / Ruling on Interlocutory Application for Mandatory Injunction

  1. 1 Whether the Plaintiff is entitled to a mandatory injunction compelling the Defendant to surrender the original Indenture and deliver vacant possession of the suit property.
  2. 2 Whether a mandatory injunction can issue at the interlocutory stage before full trial.
  3. 3 Whether the Defendant should be evicted from the suit property before her counter-claim is heard.

Ratio Decidendi

The court found that although it had previously ruled that the Defendant was to hold the suit property for the Plaintiff until she attained majority and should relinquish it, the Defendant had raised a counter-claim asserting that she is the Plaintiff's foster mother and has always lived on the property, claiming overriding interests. The court held that it would not be just to grant a mandatory injunction or order eviction at the interlocutory stage without giving the Defendant an opportunity to present her case at trial. The application for a mandatory injunction was therefore dismissed, and the matter was directed to proceed to full trial for proper determination of the parties' rights.
