Ratio Decidendi

The court found that the plaintiff was employed under a series of renewable contracts governed by the Moi University Terms of Service for Academic, Senior Library and Administrative Staff dated 1st July 1989. The defendant breached the contract by failing to provide the plaintiff with one way free passage and permissible baggage to his home upon termination of the final contract on 16th November 1999, as required by the terms. However, the plaintiff forfeited entitlement to free passage for the contract ending 5th May 1999 by not claiming it within six months as stipulated. The plaintiff was not entitled to free passage for his spouse, as he failed to prove her existence or eligibility....
