Ratio Decidendi

The court found that the Petitioner’s uncontroverted testimony established that she suffered both physical and mental abuse at the hands of the Respondent, who also deserted the matrimonial home in 2005 and had not returned for 14 years. In the absence of any evidence to the contrary, the court was satisfied that the grounds of cruelty, desertion, and irretrievable breakdown of the marriage had been established under Section 65 of the Marriage Act, 2014. Accordingly, the court pronounced a decree of divorce and ordered the dissolution of the marriage solemnized on 26 January 2002.
