Ratio Decidendi

The court found that the defendants had not established the two primary conditions for the grant of an injunction as set out in Giella v Cassman Brown, namely, a prima facie case and irreparable harm. However, since the defendants appeared to be in occupation of the suit land and the dispute was longstanding, the court determined that the balance of convenience required the maintenance of the status quo pending the hearing and determination of the suit. The court therefore declined to grant the injunction sought but ordered that the current status quo be maintained and the suit be set for hearing on a priority basis.
