Ratio Decidendi

The court found that the respondent failed to comply with the procedural requirements set out in Section 41 of the Employment Act. The claimant was not given proper notice of the disciplinary hearing, was not informed of her right to representation, and was not provided with adequate time or information to prepare her defence. The respondent did not prove that the claimant committed the alleged misconduct or that the process leading to her dismissal was fair. As such, the termination was both procedurally and substantively unfair and unlawful. However, since the respondent attempted to follow some process, the court limited compensation to two months' salary and awarded capped costs.
