The court found that the Deputy Registrar erred in principle by selecting a value from the defence without adequate reasoning or explanation, failing to consider all relevant pleadings as required by law. The correct approach is to ascertain the value of the subject matter from all pleadings, not just the plaint or defence in isolation. The Deputy Registrar's failure to provide reasons for preferring the defence value over the plaint value constituted a misapplication of discretion. The court also held that it was proper for the Deputy Registrar to offset the amount already paid by the client, as the purpose of taxation is to determine the net amount due to the advocate after accounting...
