No. 330/589 – Riara Road was to determine if there was a fraudulent under sale and, if so, to apportion the entitlement based on the true market value. Since the sale was found fraudulent and the market value determined at Kshs.100,000,000, apportionment must proceed on that basis. The court noted that Kshs.46 million from the sale proceeds is already preserved in a joint account, and the applicant did not demonstrate that this sum is inadequate to meet its entitlement.
