The court found that, pursuant to the consent order, the only outstanding issue was the determination of the market value of L.R. No. 330/589- Riara Road as at the date of sale to The Junction Limited. The court held that the most reliable valuation was that of PW1, jointly instructed by both parties, which valued the property at Kshs 100,000,000 as at 30th September 2009. The defendants' valuation was disregarded as it was not contemporaneous with the sale. The court further found that the sale of the property at Kshs 54,250,000, less than half its market value, coupled with the exclusion of the plaintiff from the transaction and failure to account for proceeds, constituted fraud....
