Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the respondent's claim for defamation was time-barred under the Limitation of Actions Act.
  2. 2 Whether the trial court had jurisdiction to entertain a defamation suit filed outside the statutory limitation period.
  3. 3 Whether the amendment of the plaint to introduce a new defendant after the limitation period was permissible.

Ratio Decidendi

The High Court held that the respondent's amended plaint, which introduced the appellant as a new defendant after the expiry of the statutory limitation period for defamation, was time-barred under Section 4(2) of the Limitation of Actions Act. Section 27 of the Act does not permit extension of time for defamation claims, and the amendment could not cure the limitation defect. The trial court therefore lacked jurisdiction to entertain the suit against the appellant. The appeal was allowed, the trial court's judgment was set aside, and the respondent's suit was struck out for want of jurisdiction.
