Ratio Decidendi

The Court found that the Claimant was employed by the Respondent based on secondary evidence from the National Social Security Fund statement and oral testimony. The Respondent terminated the Claimant's employment on 28 November 2017 without written notice and without affording her an opportunity to be heard, contrary to statutory requirements. The termination was therefore unfair. The Court awarded the Claimant compensation equivalent to five months' gross wages and one month's pay in lieu of notice, but declined the claim for accrued leave due to lack of evidential support. Costs were awarded to the Claimant.
