The High Court found that the trial court erred by failing to consider the applicant's plea of guilty and her status as a first offender, both of which are material factors in sentencing. The trial court also failed to consider the statutory option of imposing a fine before resorting to a custodial sentence, contrary to the Kenya Judiciary Sentencing Policy. The sentence of 12 months' imprisonment without an option of a fine was therefore manifestly excessive. The High Court exercised its revisionary jurisdiction to alter the sentence from imprisonment to a fine of Ksh. 50,000, taking into account the period already served in custody.
