The court held that the trial magistrate erred in failing to uphold the preliminary objection on territorial jurisdiction, as the suit property, parties, and cause of action were all located in Kilifi County, and the suit should have been filed in the nearest court with jurisdiction, namely Malindi Law Courts. The contractual clause purporting to confer jurisdiction on Mombasa or Malindi could not override clear statutory provisions. The court also found that the respondent had established a prima facie case for a temporary injunction, as she had paid for the property in full, was in possession, and faced a real risk of being denied access over a service charge dispute.
