The tribunal found that the lease agreement between the parties was for two years and expired on 1 August 2023, thus terminating the landlord/tenant relationship. The tenant failed to prove any expenditure or landlord's consent for the alleged improvements, and special damages were neither pleaded in the original reference nor strictly proved. The landlord was entitled to levy distress for rent arrears and mesne profits, which totaled Kshs. 340,000 as at the date for vacant possession. The tenant was granted thirty days to vacate, failing which the landlord could enforce eviction with police assistance. Costs were awarded to the landlord as the successful party.
