The court found that while the applicant had not demonstrated exceptional or unusual circumstances or overwhelming chances of success in the appeal, the anticipated delay in the hearing and determination of the appeal, coupled with the likelihood that the applicant would serve a substantial part of the sentence before the appeal is heard, justified the grant of bail pending appeal. The court also considered the applicant's prior compliance with bail terms during trial and the absence of any interference with witnesses or absconding. Accordingly, the court exercised its discretion to admit the applicant to bail pending appeal on the same terms as previously set by the trial court.
