The Claimant had obtained permission to be absent, and the Respondent's defence collapsed. The termination was therefore both substantively and procedurally unfair. The court awarded the Claimant six months' salary as compensation, one month's salary in lieu of notice, and leave pay for three years, as the Respondent failed to provide leave records to the contrary. The Claimant was also entitled to a certificate of service and costs.
