The only undisputed date was 8th February 2008, when the award was filed in the Senior Principal Magistrate’s Court in Muranga. Since the Notice of Motion was filed on 29th April 2008, it was within the six-month limitation period prescribed by Order LIII Rule 1(2) of the Civil Procedure Rules.
