Ratio Decidendi

The High Court held that applications for extension of the limitation period under section 27 of the Limitation of Actions Act are required by law to be heard and determined ex parte. The resulting order is provisional and not subject to appeal by a respondent who was not a party to the originating summons. The only proper way to challenge such an order is at the trial of the suit filed pursuant to the extension. The court found that the appellant's challenge by way of appeal was misconceived and lacked merit, as the law and established judicial precedent dictate that the validity of the extension can only be tested at trial, not by a separate appeal or preliminary application....
