The appellate court found that the trial magistrate's award of Kshs. 900,000 for general damages was inordinately excessive given the respondent's injuries (fracture of the right tibia and fibula) and comparable awards in similar cases. Applying the principle that appellate courts should only interfere with awards that are manifestly excessive or based on wrong principles, the court held that an award of Kshs. 500,000 would be adequate compensation. The special damages awarded by the lower court were not challenged and were upheld.
