Procedural Posture

Notice of Motion / Interlocutory Application for Injunction

  1. 1 Whether the applicants have established a prima facie case for the grant of an interlocutory injunction.
  2. 2 Whether damages would be an adequate remedy for the applicants.
  3. 3 Whether the balance of convenience favors granting the injunction.

Ratio Decidendi

The court found that the applicants failed to satisfy the conditions for the grant of an interlocutory injunction. The applicants did not controvert the respondents' assertion that the boundary verification and determination exercise had already taken place on 6/2/19. The court held that the issues raised could only be determined at a full hearing where evidence would be adduced. Since the verification exercise had already occurred and the applicants had not demonstrated a prima facie case or irreparable harm, there was no basis for the court to intervene at this stage. The application was therefore dismissed with costs.
