The court found that the 1st Defendant's claim for adverse possession failed because his occupation began with the consent of the vendor and there was no evidence that such consent was withdrawn or that he had been in adverse possession for the requisite twelve years. The registration of the 1st Defendant as owner of the entire suit property was irregular and unlawful, as he only purchased a 1/6 share and there was no evidence of transfer of the other co-owners' shares. The Registrar erred in registering the whole parcel in the 1st Defendant's name without supporting documents from all co-owners.
