The court held that the Deputy Registrar, as the Taxing Officer, is empowered to determine preliminary objections and disputes arising in the course of taxation of an advocate-client bill of costs, including whether the fees have been paid in full and whether procedural requirements such as notice have been met. There is no statutory provision or rule in the Advocates Remuneration Order that bars the Deputy Registrar from dealing with such objections prior to taxation. The language of paragraph 12 of the Advocates Remuneration Order contemplates that some disputes may be referred to the High Court with the consent of both parties, but does not mandate referral of all disputes.
