The court held that the applicant failed to file an affidavit of service to prove that the Garnishee order Nisi was served on the respondents at least seven days before the hearing, as required by Order XXII rule 1(2) of the Civil Procedure Rules. The court found that the mere presence of the parties or their advocates in court does not satisfy the mandatory requirement for service. In the absence of proof of service, the court could not allow the proceedings to continue.
