Ratio Decidendi

The application for revision was dismissed because the period spent in remand custody had already been expressly considered and credited by the appellate court (Odunga J) when substituting the life sentence with a 20-year term. Any further reduction would amount to sitting on appeal over a decision of a court of concurrent jurisdiction, which is impermissible and contrary to the doctrine of functus officio. The court found the application to be an abuse of process and without merit.
