The court found that the applicant failed to meet the legal threshold for review of a consent order as set out under section 80 of the Civil Procedure Act and Order 45 Rule 1 of the Civil Procedure Rules. The court noted that the 1st respondent, ECC, was deceased and therefore could not participate in the application, making it inappropriate to review a consent order entered into with a now-deceased party without their input. Furthermore, the court observed that the applicant, having registered the caveat herself, could withdraw it under the relevant laws without the need for a reviewed consent order. The application was thus found to be unmeritorious and was dismissed.
