Procedural Posture

Land Dispute / Judgment

  1. 1 Whether the land sold to the defendant by Chepoturom was located on parcel number West Pokot/Keringet A/2534 near the Kitale-Kapenguria road.
  2. 2 Whether the defendant should be declared a trespasser on the suit land for want of Land Control Board consent.
  3. 3 What orders should issue.

Ratio Decidendi

The court found that the defendant was sold a quarter acre of land on parcel West Pokot/Keringet A/2534, took possession upon payment, and has remained in occupation since 2010. Although no Land Control Board consent was obtained, both parties intended the sale and the land was clearly identified. The court held that equity and the doctrine of constructive trust apply, preventing the plaintiff from relying on the lack of consent to invalidate the agreement. The plaintiff's claim for trespass and eviction was dismissed, and the plaintiff was ordered to effect transfer of the quarter acre to the defendant, with the Deputy Registrar empowered to execute documents if the plaintiff defaults.

Court Disposition

plaintiff's claim dismissed; defendant entitled to transfer of land

Orders

  • The plaintiff’s claim is dismissed with costs.
  • The plaintiff shall effect the transfer of a quarter of an acre of land out of land parcel title No. WEST POKOT/KERINGET A/2534 to the defendant.
