The authenticity and rescission of the agreement are matters for substantive hearing, but for the purposes of the interlocutory application, the plaintiff demonstrated a sufficient interest in the property and possession. The threat of eviction by the defendant would cause injury not adequately compensable by damages. The plaintiff thus satisfied the criteria for a temporary injunction as set out in Giella v Cassman Brown. The court granted the interlocutory injunction and ordered the transfer of the suit to the chief magistrate court, which has jurisdiction.
