Ratio Decidendi

The court found that although a notice of withdrawal of the instant suit was filed and served, it was not endorsed by the court and was missing from the record, rendering it ineffective. Both suits involved the same parties and subject matter, but the instant suit (HCCC No. 350 of 2011) was filed before the subsequent suit (HCCC No. 353 of 2012). Under Section 6 of the Civil Procedure Act, the court cannot proceed with a suit where the matter in issue is also directly and substantially in issue in a previously instituted suit. Therefore, the later suit (HCCC No. 353 of 2012) must be stayed, and the instant suit should proceed to hearing and determination.
