The court found that the petitioner failed to deposit the mandatory security for costs of KES 100,000 as required by Section 78(2) of the Elections Act, and that there is no legal provision allowing the court to waive this requirement, even on grounds of disability or inability to pay. The court further found that the petition was served on the respondents and interested parties well outside the statutory 15-day period, in breach of Section 76(1)(a) of the Elections Act.
