The court found that the applicant's delay of two days in filing the appeal was reasonably explained by the change of counsel and was not inordinate. The court exercised its discretion to grant leave to appeal out of time. However, the applicant failed to demonstrate that she would suffer substantial loss if the stay of execution was not granted, as there was no evidence that the respondent would be unable to refund the decretal sum if the appeal succeeded.
