Procedural Posture

Notice of Motion / Ruling on Interlocutory Injunction Application

  1. 1 Whether the Plaintiff gave valid spousal consent to the charging of matrimonial property for a loan facility.
  2. 2 Whether the 3rd Defendant complied with statutory notice requirements under the Land Act before exercising the power of sale.
  3. 3 Whether the Plaintiff, as a Director and spouse, was properly served with the requisite statutory notices.

Ratio Decidendi

The court found that although the Plaintiff had signed the spousal consent and was a Director of the 2nd Defendant, the 3rd Defendant failed to serve her with the statutory notice in her capacity as a spouse as required by Section 96(2)(c) of the Land Act. The court held that service of notice to the company or as a Director does not substitute the mandatory requirement to serve the spouse who gave consent. This non-compliance with statutory requirements established a prima facie case in favour of the Plaintiff, justifying the grant of a temporary injunction to restrain the sale of the suit land pending the determination of the suit.

Court Disposition
