The Plaintiff's withdrawal of the earlier suit did not negate the fact that the court had already pronounced itself on the issues. The court held that the application for injunction was res judicata and that the interim order was obtained through non-disclosure and misrepresentation. As a result, the Defendant's application to set aside the ex parte interim order was merited and allowed, with costs awarded to the Defendant.
