The appellate court held that the correct approach is to ensure that awards for damages are consistent with established principles and comparable precedents. The court substituted the trial court's award of Kshs.800,000 for general damages with Kshs.500,000, less 10% for contributory negligence, resulting in a total of Kshs.450,000 for general damages. Special damages of Kshs.6,100 were upheld. The appellant was ordered to pay 50% of the costs of the appeal.
