Ratio Decidendi

The court held that although the Applicant filed the judicial review application outside the six-month period prescribed for certiorari, the issue of time limitation had already been considered at the leave stage. The Respondent's challenge by way of preliminary objection was therefore inappropriate; the proper procedure would have been to seek review of the order granting leave. Furthermore, the Applicant also sought an order of prohibition, which is not subject to the six-month limitation. The preliminary objection was found to lack merit and was dismissed.
