Ratio Decidendi

The court declined to grant the release of the motor vehicle or order deposit of security at this interlocutory stage, finding that the substantive applications for contempt and stay of execution had not yet been canvassed. The court held that granting such orders prior to hearing both parties in full would risk prejudicing the Respondents and undermine the proper adjudication of the pending applications. The court also found that service of the stay order was effected after office hours, and thus the Respondents could not be faulted for actions taken prior to receipt of the order. The applications must be heard and directions taken before any substantive orders can issue.
