Ratio Decidendi

The court found that by the time the stay and preservation orders were served, the orders of 27th March 2023 had already been complied with and perfected. Ecobank and I&M Bank had acted on the court's orders before being served with the subsequent stay and preservation orders. As a result, there was nothing left to stay, preserve, or revert. The applications for stay, preservation, and restitution were therefore rendered moot, having been overtaken by events. Granting the orders sought would serve no useful purpose. The applications were dismissed, and each party was directed to bear its own costs.
