The court also determined that the applicant had not demonstrated sufficient seriousness in prosecuting the appeal, and that the respondents would suffer greater prejudice if the application were granted. However, in the interest of justice, the court exercised its discretion to allow the application, granting the applicant leave to file the notice of appeal out of time, subject to payment of costs to the respondents.
