The only valid and properly gazetted PDP was No.R23/2001/3, which had already been upheld in previous litigation (Nakuru HC Misc. App No.201 of 2008). The applicants' allocation of land was therefore a nullity, and they had no legal basis to challenge the issuance or effect of PDP No.R23/2001/3.
