Section 136(a) of the Criminal Procedure Code expressly provides for the joinder and joint trial of accused persons where the offence is committed in the course of the same transaction. The fact that one case had already commenced and a witness had testified did not preclude consolidation, as it was not too late to ensure a fair and efficient trial.
