Ratio Decidendi

The court found that the prosecution failed to establish a prima facie case against the accused. None of the witnesses saw the accused commit the offence or placed him at the scene. The evidence presented did not link the accused to the death of the deceased, either directly or circumstantially. As such, the issue of malice aforethought did not arise. The court held that, in the absence of any evidence connecting the accused to the crime, it would be unsafe and contrary to law to require him to enter a defence. The accused was therefore acquitted under section 306(1) of the Criminal Procedure Code.
