NOTE ON SENTENCE
The accused had been charged with murder. Following a plea bargaining arrangement he pleaded guilty to a lesser charge of manslaughter. The circumstances of the case are clear and have been confirmed by the social inquiry report called for by the court.
The accused reported the matter to the Police upon realizing what he had done. It was a sign of honesty. He has been in prison since 4/8/2011 a period of about 20 months. The social inquiry report is very positive.
Considering all the circumstances I hereby place the accused on Probation for 24 months. Conditions explained. The District Probation Officer to give the necessary guidelines to him.
DELIVERED, DATED AND SIGNED AT EMBU THIS 12TH DAY OF APRIL 2013.
