Legal Issues
- 1 Whether the accused should be sentenced to death or life imprisonment for the offence committed.
- 2 Whether mitigating factors such as being a first offender, ill health, advanced age, and time spent in custody should influence the sentence.
Ratio Decidendi
The court, after weighing the mitigating factors presented on behalf of the accused—including his status as a first offender, his ill health, advanced age, and the period already spent in custody—against the gravity of the offence, namely the loss of life in a brutal manner, determined that the death penalty would not be imposed. Instead, the court exercised its discretion to sentence the accused to life imprisonment, finding this to be a proportionate response to the seriousness of the crime while acknowledging the mitigating circumstances.
Court Disposition
Accused sentenced to life imprisonment.
Orders
- The accused is sentenced to life imprisonment.

IN THE HIGH COURT OF KENYA AT MERU
HC CRIMINAL CASE NO. 81 OF 2014
REPUBLIC........................................................................DPP
VERSUS
ANDRIANO KITHUMBI ....................................ACCUSED
RULING ON SENTENCE
1. I have considered the able mitigation made on behalf of the accused. That he is a first offender. That he is sickly and of advanced age. I have considered that he has been in custody since 2014.
2. However, a life was lost at his hands. The victim Impact Report dated 26/09/2018 that is on record is critical of him.
3. I have also considered the brutal manner in which he ended his brother’s life.
4. In the circumstances, I will spare the accused the death penalty but sentence him to life imprisonment.
