From what has been stated above, the murder case against the 1st Accused ANNE WAMBUI NJAGI hereby marked terminated under Section 82(1) of the Criminal Procedure Code and the 1st Accused hereby discharged.
The charge of murder against the Second Accused GEOFFREY KAMAU KIRIGI hereby substituted with the charge of manslaughter and this case now ordered transferred to the Principal Magistrate’s Court at Kerugoya for trial.
The Accused Geoffrey Kamau Kirigi be produced before the said Principal Magistrate Kerugoya court for mention on 17th November, 2003 with a view to further proceedings in that court. Dated this 11th day of November, 2003. J. M. KHAMONI JUDGE
