Ratio Decidendi

The court found that the prosecution's evidence, including eyewitness testimony of the accused assaulting the deceased, medical evidence of fatal injuries, and investigative findings, was sufficient to establish a prima facie case of murder against the accused. Applying the standard set out in Bhatt v R [1957] EA 332, the court held that the accused must be put on his defence as there is evidence on record which, if believed, would support a conviction. The accused was therefore called upon to indicate how he wished to proceed with his defence, in accordance with Section 306(2) of the Criminal Procedure Code.
