Procedural Posture

Miscellaneous Criminal Application / Ruling on Application for Revision of Bail Orders

  1. 1 Whether the trial court erred in releasing the respondent on cash bail despite the complexity and public interest in the case.
  2. 2 Whether the custodial orders should be vacated in light of the respondent's new status as a prosecution witness.

Ratio Decidendi

The court found that, although the initial bail orders were set aside due to the complexity and public interest in the murder investigation, subsequent developments established that the respondent was not implicated in the offence and had become a cooperating prosecution witness. In light of the absence of evidence against the respondent and his new status, the continued custodial orders were no longer justified. The court therefore vacated the custodial orders, directed the refund of cash bail, and ordered that the respondent be accorded witness protection under the relevant statute.

Court Disposition

application allowed; custodial orders vacated; cash bail refunded; witness protection ordered

Orders

  • The custodial orders issued on 19th May 2025 are hereby vacated.
  • Cash bail shall be refunded to the respondent.
