The court found that while the ex-parte applicant was awarded costs in Miscellaneous Civil Application No. 362 of 2006, the Attorney General was sued only in a representative capacity for the Auctioneers Licensing Board, a government agency. The Attorney General is not the accounting officer of the 2nd Respondent and cannot be compelled by mandamus to settle the decree. The applicant failed to demonstrate that the decree or certificate of costs was served on the 2nd Respondent or that any attempt was made to seek payment from it.
